1. Acceptance of Terms

Welcome to evite.ink (the "Service"), operated by evite.ink ("we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and us.

By accessing our website, creating an account, or using our Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree with these Terms, you must not access or use the Service.

2. Description of the Service

evite.ink provides a platform for users to create, customize, purchase, and share digital wedding invitations. The Service includes access to a library of design themes, a web-based editor for personalization, payment processing for theme purchases, and hosting of the final digital invitation at a unique public URL.

3. User Accounts and Responsibilities

a. Account Creation: To access the core features of the Service, you must register for an account. We use Google Sign-In for authentication. You are responsible for providing accurate information and for all activities that occur under your account.

b. Account Security: You are responsible for maintaining the confidentiality of your account access. You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.

c. Eligibility: You must be at least 18 years of age to create an account and use our Service.

4. User-Generated Content (UGC)

You are solely responsible for all text, data, photographs, graphics, messages, or other materials ("User Content") that you upload, post, or input into the Service.

a. Ownership of Your Content: You retain full ownership and all intellectual property rights to the User Content you create. We do not claim any ownership rights over your personal text or photos.

b. License Granted to Us: By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, create derivative works from, display, and distribute your User Content. This license is strictly for the limited purpose of operating, providing, improving, and promoting the Service. For example, we need this license to generate your invitation on our servers and display it to your guests via the public URL. This license ends when you delete your User Content or your account.

c. Prohibited Content: You agree not to upload any User Content that:

  • Is illegal, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable.
  • Infringes on the intellectual property rights (e.g., copyright, trademark) of any third party. You warrant that you have the necessary permissions for any photos or text you use that you did not create yourself.
  • Contains viruses, malicious code, or other harmful components.

We reserve the right, but not the obligation, to review and remove any User Content that violates these Terms at our sole discretion.

5. Intellectual Property Rights

a. Our Intellectual Property: Excluding your User Content, all aspects of the Service, including but not limited to the invitation themes, website design, text, graphics, logos, software, and underlying code, are the exclusive property of evite.ink and are protected by copyright, trademark, and other intellectual property laws.

b. Your License to Use a Theme: When you purchase a theme, you are purchasing a limited, non-exclusive, non-transferable, non-sublicensable license to use that theme for one single invitation. This license does not grant you ownership of the theme design. You may not resell, redistribute, copy, or use our themes or their components for any other commercial or personal project without our express written permission.

6. Purchases and Payments

a. Fees: The Service is offered on a per-invitation purchase basis. The price for each theme is clearly displayed. All prices are final.

b. Payment Processor: We use a third-party payment processor, Razorpay, to handle all transactions. We do not collect or store your financial information, such as credit card numbers. By making a purchase, you agree to be bound by Razorpay's Terms of Service and Privacy Policy.

c. Activation: An invitation is considered "active" and publicly available only after a successful payment has been verified by our system. Before payment, your invitation remains in a "draft" state and is not publicly accessible.

d. Refund Policy: Due to the digital nature of our products, all purchases are final and non-refundable. Please review our full Refund Policy for details on the limited exceptions.

7. Copyright Infringement (Takedown Policy)

We respect the intellectual property of others. If you believe that your copyrighted work has been copied and is accessible on the Service in a way that constitutes copyright infringement, please notify us. All such notices should be sent to our designated agent via the form on our Contact Us page.

8. Termination of Service

a. Termination by You: You may stop using the Service and delete your account at any time by sending a request through our Contact Us page.

b. Termination by Us: We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL evite.ink, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.

11. Indemnification

You agree to defend, indemnify, and hold harmless evite.ink and its employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with [Governing Law, e.g., the laws of India], without regard to its conflict of law provisions.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in [Your Jurisdiction, e.g., Jaipur, Rajasthan, India].
